Federal Judge Orders Freedom of Kilmar Abrego Garcia from ICE Custody

A court has ordered the immediate release of Kilmar Abrego Garcia from detention by ICE, finding his continued confinement lacks legal authority.

"Since Abrego Garcia's return from wrongful detention in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis stated in her order.

The situation stems from a mistaken deportation to El Salvador earlier this year, which US authorities later acknowledged was an mistake. After his return to the United States to face alien smuggling allegations, he was held in immigration custody.

In her order, the court pointed out that the authorities does not have a current removal order, which prevents them from deporting Mr. Abrego Garcia "at this juncture."

The court proceedings center on disputed assertions. While the former administration contends that Abrego Garcia is a affiliate of the MS-13 criminal organization, he categorically denies this allegation.
